The following additional terms shall apply with respect to Customer’s use of security orchestration and automation functionality included in Rapid7’s products and services (the “Orchestration and Automation Functionality”). To the extent that any such additional terms are inconsistent with the terms of Customer’s existing agreement(s) with Rapid7, such additional terms shall control, but only with respect to Customer’s use of the Orchestration and Automation Functionality. Customer’s use of the Orchestration and Automation Functionality constitutes acceptance of these additional terms.
Customer is responsible for implementing appropriate procedures and checkpoints to satisfy its requirements for configuration of workflows and processes, including but not limited to containment actions, quarantine actions, kill processes and other Orchestration and Automation Functionality. THE ORCHESTRATION AND AUTOMATION FUNCTIONALITY IS MADE AVAILABLE BY RAPID7 ON AN “AS-IS” BASIS TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. Rapid7 expressly disclaims all warranties of any kind, express or implied, with respect to the Orchestration and Automation Functionality, including without limitation all warranties of merchantability, fitness for a particular purpose and non-infringement. Without limiting the generality of the foregoing, Rapid7 makes no warranties that: (i) the Orchestration and Automation Functionality will meet Customer’s requirements; (ii) the operation of the Orchestration and Automation Functionality will be uninterrupted, timely, secure, or error-free; (iii) the results that may be obtained from the use of the Orchestration and Automation Functionality will be accurate or reliable; (iv) the quality of the Orchestration and Automation Functionality will meet Customer’s expectations; or (v) any errors in the Orchestration and Automation Functionality will be corrected. Rapid7’s Orchestration and Automation Functionality is not designed, intended or licensed for use in hazardous environments or other applications where a malfunction could cause property damage or personal injury, and Rapid7 specifically disclaims any liability in connection with any such use. Customer assumes all risks in using third-party products or services in connection with the Orchestration and Automation Functionality.
